Welcome to OptiDerm.
The terms "we", "us" and "our" refer to OptiDerm.
OptiDerm operates this website and online store, including all related information, content, features, tools, products and services made available through the website (collectively, the "Services").
OptiDerm is powered by Shopify, which provides the ecommerce platform that enables us to make our Services and products available to you.
These Terms of Service, together with any policies referenced within them, including our Privacy Policy and Returns, Refunds & Warranty Policy, describe your rights and responsibilities when accessing our website, purchasing our products or otherwise using our Services.
Please read these Terms carefully. They contain important information regarding your legal rights and responsibilities, product use, warranties and limitations of liability.
By visiting, interacting with or using our Services or purchasing from OptiDerm, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree with these Terms or our Privacy Policy, you should not access or use our Services.
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
SECTION 1 – ACCESS AND ACCOUNTS
By using the Services, you represent that you are legally capable of entering into an agreement with us.
Where you permit a minor to access our Services through a device, account or payment method that you own or control, you are responsible for supervising that access.
To browse our website, create an account or purchase products, you may be required to provide certain information, including your name, email address, telephone number, billing information, payment information and shipping address.
You agree that all information supplied to us is accurate, current and complete and that you have the authority to provide that information.
You are responsible for maintaining the confidentiality and security of your account details and credentials and for activity occurring through your account.
You must not transfer, sell, assign or provide your account to another person without our permission.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to accurately display and describe our products, including product specifications, photographs, colours and features.
However, the appearance and colour of products may vary slightly depending on the device, screen settings and display technology you use to view our website.
Product packaging, presentation, specifications and components may also be updated from time to time.
We reserve the right to modify or discontinue products and to limit quantities available for purchase, subject to applicable law.
Nothing in this section limits any consumer guarantee applicable under the Australian Consumer Law.
SECTION 3 – LED LIGHT THERAPY PRODUCTS
OptiDerm LED products are intended to be used in accordance with the instructions, safety information, contraindications and precautions supplied with the device.
Before using an OptiDerm LED device, you must read and follow the product instructions carefully.
You should not use the device in a manner inconsistent with its intended use or supplied instructions.
If you are unsure whether LED light therapy is suitable for you, you should seek advice from an appropriately qualified healthcare professional before using the device.
You should take particular care and seek appropriate advice where relevant if you have a medical or skin condition, have a known sensitivity to light, are taking medication that may cause photosensitivity, have recently undergone a medical or cosmetic procedure, are pregnant or breastfeeding and are unsure about product suitability, have previously experienced an unusual reaction to light-based treatments, or have been advised by a healthcare professional to avoid LED or light-based treatments.
You must follow any contraindications and safety warnings contained in the product instructions.
Stop using the product and seek appropriate professional advice if you experience an unexpected, significant or concerning reaction.
OptiDerm is not responsible for loss or damage caused by deliberate misuse, unauthorised modification or use of a product contrary to its supplied instructions, except to the extent that liability cannot lawfully be excluded.
SECTION 4 – RESULTS AND PRODUCT EXPECTATIONS
Individual skincare and cosmetic outcomes vary from person to person.
We do not guarantee that use of an OptiDerm product will produce a particular cosmetic result or that a result will occur within a particular timeframe.
Results may depend on numerous individual factors including skin type, skin concerns, age, consistency of use, frequency of treatment, lifestyle, existing skincare routines, medications, medical conditions, environmental exposure and other treatments or procedures.
Any before-and-after photographs, reviews, testimonials, clinical examples or customer experiences shown on our website or marketing materials are provided as examples and should not be interpreted as a guarantee that another person will achieve an identical result.
SECTION 5 – GENERAL INFORMATION AND MEDICAL DISCLAIMER
Information provided through OptiDerm's website, social media, email communications, product information and educational materials is provided for general information and educational purposes.
It should not be regarded as personalised medical advice, diagnosis or treatment.
Information provided by OptiDerm does not replace consultation with a doctor, dermatologist or other appropriately qualified healthcare professional where professional assessment is required.
If you have concerns about your health, skin condition, medications or suitability for a product, you should seek appropriate professional advice.
Nothing in these Terms is intended to alter any therapeutic purpose, indication or claim lawfully associated with an OptiDerm product.
SECTION 6 – ORDERS
When you submit an order through our website, you are making an offer to purchase the products included in that order.
Your order is accepted when we confirm acceptance or otherwise process the order for fulfilment.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, product or pricing information contains an obvious error, payment cannot be processed, we cannot verify relevant order information, we reasonably suspect fraudulent or unauthorised activity, an order appears to have been placed for unauthorised commercial resale, or we are unable to lawfully fulfil the order.
If we cancel an order after payment has been taken, any amount due to you will be returned to your original payment method.
Please review your order carefully before submitting it. Once an order has entered processing or dispatch, we may not be able to accommodate a cancellation or change request.
Where reasonably possible, we will attempt to contact you using the email address, telephone number or other contact details supplied with your order if there is an issue.
SECTION 7 – PERSONAL USE
Unless otherwise agreed by OptiDerm, products purchased through our online store are intended for personal or household use.
You must not purchase OptiDerm products for unauthorised commercial resale, redistribution or export.
If you are interested in stocking or distributing OptiDerm products commercially, you must contact us separately for approval.
SECTION 8 – PRICING AND PAYMENT
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars (AUD).
Prices, promotions and discounts may change from time to time.
The price applicable to your transaction will generally be the price displayed when your order is submitted, subject to genuine pricing, technical or administrative errors and applicable law.
Shipping costs and other applicable charges will be disclosed where applicable before checkout is completed.
You agree to provide accurate and current purchase, billing and payment information.
By providing payment details, you represent that you are authorised to use the selected payment method.
Payment must be successfully authorised before we are required to fulfil your order.
Third-party payment providers may impose their own additional terms and conditions.
SECTION 9 – PROMOTIONS AND DISCOUNT CODES
From time to time, OptiDerm may offer promotional pricing, discount codes, bundles, gifts with purchase or other special offers.
Separate promotional terms may apply.
Unless otherwise stated, promotions apply during the advertised promotional period, discount codes cannot be combined, discount codes cannot be retrospectively applied to completed purchases, discounts have no cash value and promotions are subject to product availability.
If specific promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion to the extent of the inconsistency.
We may correct or withdraw a promotion that contains a genuine error, subject to applicable law.
SECTION 10 – SHIPPING AND DELIVERY
Delivery estimates provided by OptiDerm are estimates only unless expressly stated otherwise.
Delivery times may be affected by circumstances outside our reasonable control, including courier delays, postal disruption, extreme weather, public holidays, customs processing or other delivery network interruptions.
Customers are responsible for providing a complete and accurate delivery address.
If you notice an error in your shipping details, please contact us as soon as possible. We cannot guarantee that an address can be amended once an order has been processed or dispatched.
Nothing in this section excludes any rights you may have under Australian Consumer Law where products are not delivered within an agreed or reasonable timeframe.
SECTION 11 – 14-DAY RETURNS
OptiDerm offers a 14-day change-of-mind return period.
You have 14 days from the date you receive your order to request an eligible return.
To qualify for a change-of-mind return, the product must be in the same condition in which it was received, unused, show no signs of use or wear, include all components and accessories, be returned in its original packaging and be accompanied by proof of purchase.
For hygiene and safety reasons, an LED mask that has been used or worn cannot be returned for change of mind.
This hygiene restriction does not affect your rights where the product is faulty, defective or otherwise fails to satisfy a consumer guarantee under Australian Consumer Law.

SECTION 12 – FAULTY, DAMAGED OR INCORRECT PRODUCTS
Please inspect your order after delivery.
If your order is damaged, defective, faulty or you receive an incorrect product, contact us as soon as reasonably possible at Hello@optiderm.com.au.
We may request your order number, a description of the issue, photographs, video demonstrating the fault or other information reasonably necessary to assess the issue.
We will assess the matter and provide a remedy in accordance with your rights under Australian Consumer Law and any additional applicable OptiDerm warranty.
SECTION 13 – 12-MONTH OPTIDERM LED WARRANTY
OptiDerm LED masks include a 12-month OptiDerm warranty from the date of purchase against manufacturing defects and faults occurring during normal intended use.
This warranty is provided in addition to your rights under Australian Consumer Law.
The 12-month warranty period does not limit any consumer guarantee rights that may continue to apply beyond the warranty period.

You may be required to provide proof of purchase together with photographs, video or other reasonable information demonstrating the issue.
The OptiDerm warranty does not cover faults or damage caused by accidental damage, dropping or impact, misuse or neglect, improper handling or storage, unauthorised modification or repair, failure to follow supplied instructions, liquid or water damage where such exposure is not permitted, use with incompatible chargers, adapters, accessories or power sources, normal wear and tear that does not constitute a product failure, or damage caused by circumstances unrelated to a manufacturing defect.
Where a valid warranty claim is confirmed, we will provide an appropriate remedy, which may include repair, replacement or another remedy as required or permitted by applicable law.
SECTION 14 – AUSTRALIAN CONSUMER LAW
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms or any OptiDerm policy is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded.
Depending on the circumstances and nature of a product failure, you may be entitled to a repair, replacement, refund or other remedy under Australian Consumer Law.
Our voluntary 12-month LED warranty and 14-day change-of-mind policy operate in addition to your statutory consumer rights.
SECTION 15 – REFUNDS
Approved refunds will generally be returned to the original payment method used for the purchase.
Once an eligible returned product has been received and inspected, we will notify you regarding the outcome of the return.
Where a refund is approved, we aim to process it within 10 business days.
Your financial institution or payment provider may require additional processing time before funds appear in your account.
If more than 15 business days have passed after we have confirmed approval of your refund, contact Hello@optiderm.com.au.
Nothing in this section limits any timeframe or remedy required by Australian Consumer Law.
SECTION 16 – INTELLECTUAL PROPERTY
The Services and their content, including the OptiDerm name, logos, product names, product designs, website design, written copy, photographs, graphics, videos, audio, educational materials, product descriptions, branding and marketing materials are owned by, licensed to or lawfully used by OptiDerm and are protected by applicable Australian and international intellectual property laws.
The Services are provided for your personal, non-commercial use.
Unless permitted by law or expressly authorised by us in writing, you must not copy, reproduce, modify, publish, republish, distribute, transmit, commercially exploit or create derivative works from OptiDerm content.
Nothing in these Terms grants you ownership of or a licence to use OptiDerm trademarks, branding or intellectual property except as expressly stated.
Shopify's trademarks, logos, products and intellectual property remain the property of Shopify or its applicable licensors.
SECTION 17 – OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to tools, functions or services operated by third parties.
We may not control or monitor these tools and cannot guarantee their continued availability.
Use of a third-party tool may be subject to that provider's own terms, privacy practices and conditions.
To the extent permitted by law, OptiDerm is not responsible for independent third-party services that are outside our reasonable control.
We may introduce new website features, tools and resources in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.
SECTION 18 – THIRD-PARTY LINKS
Our Services may contain links to or functionality provided by third-party websites and services.
OptiDerm does not necessarily control, endorse or take responsibility for independent third-party content, products, services, privacy practices or websites.
If you choose to access a third-party website, you should review its applicable terms and privacy policy.
Any questions or claims relating specifically to a third-party product or service should generally be directed to that provider.
Nothing in this section excludes liability that cannot lawfully be excluded.
SECTION 19 – RELATIONSHIP WITH SHOPIFY
OptiDerm is powered by Shopify, which enables us to provide our ecommerce Services to you.
However, purchases made through the OptiDerm store are transactions between you and OptiDerm.
Shopify provides technology and ecommerce infrastructure but is not the seller of OptiDerm products.
To the extent permitted by applicable law, Shopify is not responsible for the products sold by OptiDerm or for disputes arising directly between you and OptiDerm concerning those products.
Nothing in this section affects any rights you may have against a party where liability cannot lawfully be excluded.
SECTION 20 – PRIVACY
Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable privacy laws.
Because our Services are hosted by Shopify, Shopify may collect and process certain personal information relating to your use of the Services in order to provide its technology and services.
Information may also be processed by service providers assisting us with payment processing, website hosting, order fulfilment, shipping, customer communications, analytics and marketing where permitted.
Please refer to our Privacy Policy for further information about the way personal information is collected, used, stored and disclosed.
SECTION 21 – FEEDBACK, REVIEWS AND USER CONTENT
If you voluntarily submit a product review, testimonial, photograph, video, suggestion, idea or other content to OptiDerm ("Feedback"), you represent that you have the necessary rights to provide it.
Unless otherwise agreed, by submitting Feedback for publication or promotional use, you grant OptiDerm a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and communicate that Feedback for legitimate business, website and marketing purposes.
Where your Feedback contains personal information or identifiable photographs, our use of that information remains subject to applicable privacy laws and any consent requirements.
You must not submit Feedback that infringes another person's intellectual property, violates another person's privacy rights, is unlawfully defamatory, contains malicious software, is fraudulent or deliberately misleading, or is otherwise unlawful.
You are responsible for the accuracy and legality of content you submit.
We may moderate or remove user content where reasonably necessary, including where content is unlawful, fraudulent, abusive, spam, irrelevant or infringes the rights of another party.
SECTION 22 – ERRORS, INACCURACIES AND OMISSIONS
Our Services may occasionally contain typographical errors, technical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times or product information.
We reserve the right to correct genuine errors and update inaccurate information.
Where an error affects an order you have already submitted, we will deal with the matter reasonably and in accordance with applicable Australian law.
Nothing in this section permits us to mislead consumers or avoid obligations imposed by Australian Consumer Law.
SECTION 23 – PROHIBITED USES
You may only use our Services for lawful purposes.
You must not use or attempt to use the Services for unlawful, fraudulent or malicious activity; to infringe our intellectual property or the rights of another party; to harass, threaten, intimidate or unlawfully defame another person; to submit deliberately false or misleading information; to distribute viruses, malware or harmful code; to impersonate another person or entity; to collect personal information unlawfully; to send spam or unsolicited electronic communications in breach of applicable law; to interfere with the operation or security of the Services; to gain unauthorised access to our systems; to bypass technological or security measures; to scrape or commercially extract substantial portions of our website or proprietary content without permission; or to reproduce, sell, resell or commercially exploit our Services without authorisation.
We may restrict or terminate access where we reasonably believe these Terms have been materially breached.
SECTION 24 – AUTOMATED SYSTEMS AND AGENTS
Where automated software, artificial intelligence agents, bots, crawlers or similar technologies access the Services, they must comply with applicable law and any technical or access restrictions implemented by OptiDerm or Shopify.
Automated systems must not misrepresent themselves as human where identification is reasonably required, circumvent CAPTCHAs or security controls, avoid technical measures intended to restrict automated access, access non-public parts of the Services without authorisation, or scrape or commercially exploit protected OptiDerm content without permission.
We may implement technical measures to restrict automated access to our Services.
SECTION 25 – TERMINATION OR SUSPENSION
We may suspend or terminate access to all or part of the Services where reasonably necessary, including where you materially breach these Terms, we reasonably suspect fraud, your activity creates a security risk, access is being used unlawfully, or continued access could materially harm OptiDerm, Shopify, another customer or a third party.
Termination does not affect any rights or liabilities that arose before termination.
Provisions which by their nature are intended to survive termination, including intellectual property, liability, privacy and governing law provisions, will continue to apply.
SECTION 26 – DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free, secure or continuously available.
Website information is provided for general informational purposes and may be updated periodically.
Nothing in these Terms excludes, restricts or modifies the consumer guarantees, warranties, rights or remedies available to you under Australian Consumer Law or any other law where those rights cannot legally be excluded.
Any disclaimer contained in these Terms operates only to the extent permitted by applicable law.
SECTION 27 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, OptiDerm will not be liable for indirect or consequential losses arising solely from matters outside our reasonable control.
OptiDerm is not responsible for loss or damage caused by misuse of a product, failure to follow supplied product instructions, ignoring stated warnings or contraindications, unauthorised alteration or repair, or use of incompatible accessories or power equipment, except where OptiDerm is responsible under applicable law or where liability cannot legally be excluded or limited.
Nothing in these Terms excludes, restricts or modifies liability for consumer guarantees or other rights and remedies that cannot lawfully be excluded under Australian Consumer Law.
SECTION 28 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify OptiDerm against reasonable losses, liabilities or claims suffered as a direct result of your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's intellectual property or legal rights.
This provision does not require you to indemnify OptiDerm for loss caused by OptiDerm's own negligence, breach of law or conduct for which liability cannot legally be excluded.
SECTION 29 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary.
The remaining provisions will continue in effect.
SECTION 30 – WAIVER AND ENTIRE AGREEMENT
If OptiDerm does not immediately exercise or enforce a right under these Terms, that does not necessarily constitute a waiver of that right.
These Terms, together with policies expressly incorporated into them, form the agreement governing your use of the Services.
Nothing in this section excludes representations, guarantees or rights that cannot lawfully be excluded.
SECTION 31 – ASSIGNMENT
You must not assign or transfer material rights or obligations under these Terms without our prior written consent where consent is reasonably required.
OptiDerm may assign or transfer its rights and obligations as part of a legitimate transfer, restructure or sale of its business, subject to applicable law.
SECTION 32 – GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws of Australia.
You and OptiDerm submit to the jurisdiction of the courts and tribunals of Victoria and Australia as applicable.
Nothing in this provision restricts any jurisdictional rights available to consumers under applicable law.
SECTION 33 – HEADINGS
Headings are included for convenience and readability only and do not affect the interpretation of these Terms.
SECTION 34 – CHANGES TO THESE TERMS
The current version of these Terms will be made available through our website.
We may update these Terms from time to time to reflect changes to our products, Services, business operations, technology, or legal and regulatory requirements.
Where required by law, material changes will be notified appropriately.
Changes will apply from the date specified in the updated Terms and will not retrospectively remove consumer rights that already apply to a completed purchase.
